DMCA & copyright

A draft copyright notice and counter-notice guide.

Draft for operator review. Not yet an effective legal policy.

Draft notice process

The service operator must appoint and verify an appropriate copyright contact or designated agent before this notice process can be used. This page does not claim DMCA registration or legal safe-harbor eligibility.

Prepare a copyright notice

A rights holder or authorized representative should identify the copyrighted work, the allegedly infringing material and its exact public URL.

  • Your name and a reliable contact method.
  • Identification of the work and the material at issue.
  • A good-faith statement that the use is not authorized.
  • A statement of accuracy and authority under penalty of perjury.
  • A physical or electronic signature.

Counter-notices

A counter-notice may require identification of removed material, a statement under penalty of perjury, a signature and consent to the appropriate court jurisdiction. Seek legal advice; requirements depend on the applicable law.

Abuse and repeat infringement

A final policy must define review, notification, appeals and repeat-infringer handling. Do not use copyright notices to suppress content you do not own.
